Your Guide to Complying Development Certificates in NSW

If you’re planning to build, renovate or expand a site in NSW you will need approval before starting work. Many industrial projects go through the standard development approval (DA) process, however if your project meets specific requirements, you may be eligible for a Complying Development Certificate (CDC).

A CDC is a fast-track approval process for projects that meet specific planning rules and guidelines set out under the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008. Compared to the DA process, securing a CDC is much simpler, faster and cheaper. 

In the industrial sector, CDCs are often used for straightforward projects such as storage sheds, warehouses, factory unit developments, awnings, internal fitouts, upgrades, and general renovations.

Eligibility for a CDC

Not all projects will be eligible for a CDC. To qualify, your project must:

  • Meet certain planning conditions 
  • Meet specific building standards (height, size etc)
  • Align with local zoning requirements for your site
  • Comply with the National Construction Code 

If your project does not meet these criteria, you will need to lodge a development application instead. 

The Application Process

To apply for a CDC, you will need a range of documents to demonstrate that your project complies with the requirements. These typically include:

  • Architectural and site plans
  • Civil and stormwater plans 
  • Structural and engineering plans
  • Mechanical plans
  • Fire engineering designs
  • Planning compliance report
  • Energy efficiency reports
  • National Construction Code Compliance report
  • Access report
  • Dilapidation report

  • Owners consent if the property is leased 

Once the documentation has been prepared, you can lodge an application with a registered private certifier or your local Council. 

Unlike the multiple stage DA process, a CDC is assessed against fixed planning and building standards. If your application is deemed compliant by the certifier, your certificate is typically issued within weeks, allowing you to legally begin construction.

A Tip for Success: Working with an Industrial Planner 

Whilst securing a Complying Development Certificate is much faster than a development application, understanding the eligibility criteria and preparing compliant documentation can still be complex. Engaging an industrial planner can make the process smoother and more efficient by:

  • Assessing your project and advising whether a CDC is appropriate
  • Managing consultants (engineers, surveyors, architects etc)
  • Compiling and submitting your application
  • Coordinating with certifiers for timely approval

A Complying Development Certificate can be the fastest and most cost-effective way to get your industrial project approved in NSW. By meeting the strict criteria and preparing a comprehensive application, you can bypass the lengthy DA process and begin construction much sooner.
