Complying Development Certificate or Development Application: Choosing the Right Approval Pathway

If you’re planning to build, renovate or expand a site in NSW, a Complying Development Certificate (CDC) may provide a faster approval pathway for projects that meet specific planning rules under the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008. Compared with a Development Application (DA), a CDC is generally simpler, faster and more cost-effective.

A CDC is only available where a project strictly complies with the relevant planning requirements. Even a minor variation can make a project ineligible and require a full DA instead. For businesses and developers, assessing your development strategy early helps avoid delays, redesign costs and duplicated application work. While a DA may involve a higher upfront cost, it is often far more cost-effective than starting with a CDC and needing to pivot midway through due to ineligibility. 

In the industrial sector, CDCs are commonly used for straightforward projects such as certain demolition works, storage sheds, warehouses, factory unit developments, awnings, building alterations, internal fit-outs, upgrades and general renovations.

To qualify for a CDC, your project must:

  • Meet all relevant planning requirements
  • Comply with specific building standards (such as height, size and setbacks)
  • Be permissible under the zoning of your site
  • Comply with the National Construction Code

If your project does not meet these requirements, you will need to lodge a DA instead.
