The Independent Environmental Audit Process for State Significant Developments

In New South Wales, State Significant Developments (SSDs) are subject to strict regulatory oversight due to their scale and potential environmental impact. One of the primary compliance mechanisms for these projects is the independent environmental audit.

An independent environmental audit is a structured review of a project’s environmental performance. For SSDs, audits are required under development consent conditions and must be undertaken by an independent auditor approved by the NSW Department of Planning, Housing and Infrastructure.

The audit assesses whether the development:

  • Is operating in accordance with its development consent and EPA licence (if applicable)
  • Has implemented its approved environmental management plans
  • Has engaged effectively with the community and has responded appropriately to complaints 
  • Maintains effective monitoring and environmental risk management systems

Beyond assessing current compliance, audits also review performance over time to identify recurring issues and improvement opportunities.

  • Audit initiation – Request and review of relevant documentation and previous audit findings to define scope. We also liaise with agencies to seek feedback on the environmental performance of the development (where required)
  • Document review – Assessment of consent conditions, EPA licence requirements and key risk areas to inform the audit plan
  • Audit plan preparation – Development of a structured plan outlining scope, criteria and responsibilities
  • Onsite audit – Opening meeting, document verification, interviews and site inspection to assess compliance, followed by presentation of findings
  • Audit report – Formal documentation and issue of final observations and conclusions

Independent environmental audits are a regulatory requirement for SSDs, but they also provide a practical opportunity to reduce compliance risk, strengthen environmental management, and improve overall performance.
