Securing an EPA Licence in NSW

An Environment Protection Authority (EPA) licence is a legal requirement in NSW for businesses carrying on scheduled activities as per Schedule 1 of the Protection of the Environment Operations Act 1997. The licence regulates how your business manages pollutants affecting air, water, noise, waste and land. Businesses that require EPA licences include industries, such as manufacturing, waste management, recycling, energy generation and mining.

How to Apply for an EPA licence:

  1. Determine if your activity is scheduled (check the EPA’s Scheduled Activities List).
  2. Engage an expert environmental planner. A comprehensive application is essential in applying for an EPA licence. The documentation you need will vary based on the nature and scale of your operations. Common requirements include environmental impact assessments, operational environmental management plans, site plans, process descriptions and a pollution incident response management plan. Partnering with an experienced environmental planner early, ensures you a thorough, compliant application that will increase your chances of a successful EPA licence approval.
  3. Once your documentation has been prepared, you will need to submit your application through the EPA’s E-Connect Portal and pay the fee. If you are working with a professional planner, they will often lodge the application on your behalf.
  4. The EPA will then review your documentation. It is common for the EPA to request further information or clarification. To ensure your application is processed as fast as possible it is important to respond to EPA questions promptly. Processing times vary but can take weeks to months, depending on the complexity and environmental risk of the project.
  5. Once the EPA grants your licence, it is up to you to ensure that you adhere to the conditions outlined in the licence. This may include environmental monitoring, reporting and inspections by EPA. Keep in mind that non-compliance with your EPA licence can result in heavy fines or even suspension of operations.
  6. Keep in mind that your EPA licence will need to be renewed, typically every five years depending on the business operations. It is essential to demonstrate that your business has complied with the EPA licence for its term to ensure a smooth renewal.

It is also worthy to note that if you’re lodging a DA for a scheduled activity, Council will need to consult the EPA before your consent is issued. In most cases you need your EPA licence before you commence operations.
